Personal Data Protection Notice for Q-dees Group of Companies

The Q-dees Group of Companies (i.e. Q-dees Worldwide Edusystems (M) Sdn Bhd together with its parent, subsidiaries, affiliates, related and associated companies), including our nominees and third party franchisees (collectively referred to as “Q-dees”), respects and is committed to the protection of your personal data and your privacy. This Personal Data Protection Notice explains how we collect and handle your personal data. Please note that Q-dees may amend this Personal Data Protection Notice at any time without prior notice. You can choose not to provide certain information, but you may not be able to enjoy all the features of our services provided by Q-dees. Personal Information we learn from you helps us to personalise and continually improve your experience.

Please be informed that your personal data may be disclosed, process, disseminated and/or transferred to companies within Q-dees, Q-dees’ subsidiaries and affiliates and/or third parties, such as credit card verification providers, data analytics, marketing agency, education-related businesses, safety and security personnel, parties which have business or contractual dealings with Q-dees and its subsidiaries or affiliates. As part of our effort to serve you better, we are constantly enhancing and expanding our services to fulfill your ever-growing needs. In order to realise this business aim, we will from time to time appoint, authorise or contract with strategic business partners. Your Personal Information may be disclosed to these business partners, authorised or contracted third parties, service providers or advertisers to make available promotions, offers, products or services, which may or may not belong to us but relate to the products or services you have elected to obtain from us.

It is your obligation to ensure that all personal data submitted to and retained by Q-dees are accurate, not misleading, updated and complete in all aspects. For the avoidance of doubt, we and/or the Group and/or its employees or authorized officers or agents will not be responsible for any personal data submitted by you to us that is inaccurate, misleading, incomplete and not updated. For the avoidance of doubt, the term “employee” herein includes reference to all permanent staff, contractual staff, interns, attachment students, trainees and volunteers.

Q-dees Group of Companies shall not be responsible for the actions of its franchisees and any third party who obtain the personal data from Q-dees Group of Companies.The franchisee and any third party shall abide to the applicable data protection laws on its own accord.

(1) Personal data

1.1 Type of personal data

Personal data means any information which relates to you and which was collected or provided to Q-dees for the purposes stated in Section 2 below.

Your personal data may include your name, contact details, religion, NRIC, working/business experience, academic records, medical details, birth certificate, information in audio and/or video format (including voice and video recordings and closed-circuit television (“CCTV”) or security recordings), images (including photographs) and location tracking / GPS information.

1.2 Source of personal data

(i) Franchisee or potential franchisee: Q-dees collects your personal data directly from you or indirectly from referrals when you and/or your referees register your interest with us to establish a new franchise via various means, including through emails online, physical letters, by completing the relevant registration form or through information obtained via the internet. Your personal data may also be collected from cookies through the use of our website.
(ii) Student or potential student: Q-dees collects your personal data directly from you or indirectly from your parents or guardians when you, your parents or guardians send us completed enquiry, application and / or registration forms via various means, including online and physical hardcopies at public venues, roadshows and / or when you, your parents or guardians visit our centres or through information obtained via the internet. Your personal data may also be collected from cookies through the use of our website.
(iii) Parent / guardian of our students or potential students: Q-dees collects your personal data directly from you or indirectly from your child / ward when you or your child / ward send us completed enquiry, application and / or registration forms via various means, including online and physical hardcopies at public venues, roadshows and / or when you or your child / ward visit our centres or through information obtained via the internet. Your personal data may also be collected from cookies through the use of our website.
(iv) Vendor, supplier, tenant or service provider: Q-dees collects your personal data directly from you or indirectly from your employer or credit reference agencies when tendering for projects or as part of the commercial transaction or through information obtained via the internet. Your personal data may also be collected from cookies through the use of our website.

1.3 Obligatory personal data

All information requested for in the relevant forms is obligatory to be provided by you unless stated otherwise. Should you fail to provide the obligatory information, we may be unable to process your request and / or provide you with relevant services.

(2) Purposes of collecting and further processing (including disclosing) your personal data

(i) Franchisee or potential franchisee: Your personal data is collected and further processed by Q-dees as required or permitted by law and for various franchising and administrative purposes, including the following:

  • to assess your suitability as our franchisee including conducting the necessary background checks and due diligence for such purpose;
  • to administer and communicate with you in relation to any matter pertaining to the franchise and payments relating to the same;
  • to facilitate your participation in any contests or events;
  • to administer and communicate with you in relation to our services and/or events;

for the general administration of our franchisees;

  • to resolve disputes within our centres and assess action which may be taken in respect of internal investigations, audit or for security purposes;
  • to conduct internal marketing analysis, statistical, modelling or other franchisee marketing activities, where applicable;
  • to comply with Q-dees’ legal and regulatory obligations in the conduct of its business;
  • to contact you regarding products, services, upcoming events, promotions, advertising, marketing and commercial materials which we feel may interest you*;
  • to ensure that the content from our website is presented in the most effective manner for you and for your computer and/or device; and
  • for Q-dees’ internal records management.

(ii) Student or potential student: Your personal data is collected and further processed by Q-dees as required or permitted by law and for various academic, educational and administrative purposes, including the following:

  • to process your application for admission and thereafter to ensure continuous provision of academic and educational services to you;
    • to administer and communicate with you in relation to our tuition fees and other relevant payments;
  • to facilitate your participation in any contests or events (including field trips);
  • to administer and communicate with you in relation to our services and/or events;
  • to manage your use of our facilities and equipment within the Q-dees centre or other such relevant venue;
  • to operate our centres in a manner which is physically safe, secure and befitting of health and safety requirements;
  • to resolve disputes within our centres and assess action which may be taken in respect of internal investigations, audit or for security purposes;
  • to conduct internal marketing analysis and analysis of consumer pattern and choice;
  • to comply with Q-dees’ legal and regulatory obligations in the conduct of its business;
  • to contact you regarding products, services, upcoming events, promotions, advertising, marketing and commercial materials which we feel may interest you*;
  • to contact you regarding any relevant “alumni” matters;
  • to ensure that the content from our website is presented in the most effective manner for you and for your computer and/or device; and
  • for Q-dees’ internal records management.

In particular, medical details are processed so that we may properly accommodate and make provisions for you at our centres e.g. dietary requirements, allergy provisions, etc. (iii) Parent / guardian of our student or potential student: Your personal data is collected and further processed by Q-dees as required or permitted by law and for various academic, educational and administrative purposes, including the following:

  • to process the student’s application for admission;
  • to administer and communicate with you in relation to our tuition fees and other relevant payments;
  • to facilitate your / your child’s participation in any contests or events;
  • to administer and communicate with you in relation to our services and/or events;
  • to contact you in the event of emergency or accident;
  • to inform you about the progress of the students;
  • to resolve disputes within our centres and assess action which may be taken in respect of internal investigations, audit or for security purposes;
  • The Registrar of Franchises in the Ministry of Domestic Trade Co-operatives and Consumerism, other relevant government departments / agencies, statutory authorities and industry regulators;
  • Any person to whom we are compelled or required to do so under law or in response to a competent or government agency;
  • Relevant professional or statutory regulatory bodies or accreditation bodies;
  • Law enforcement agencies; and
  • Third parties appointed by us to provide services to us or on our behalf (such as auditors, lawyers, company secretaries, printing companies, telecommunications companies, contractors, conference / training / event organisers, other advisers, travel agencies, recruitment agencies and insurance companies).

(ii) Student or potential student: Your personal data may be disclosed to the following classes of third parties:

Relevant government departments / agencies, statutory authorities and industry regulators; to conduct internal marketing analysis and analysis of consumer pattern and choice; to comply with Q-dees’ legal and regulatory obligations in the conduct of its business

  • to contact you regarding products, services, upcoming events, promotions, advertising, marketing and commercial materials which we feel may interest you*;
  • to contact you regarding any relevant “alumni” matters;
  • to ensure that the content from our website is presented in the most effective manner for you and for your computer and/or device; and
  • for Q-dees’ internal records management.

(iv) Vendor, supplier, tenant or service provider: Your personal data is collected and further processed by Q-dees as required or permitted by law and to give effect to your requested commercial transaction, including the following:

  • to administer and give effect to the commercial transaction;
  • to process any payments related to the commercial transaction;
  • for internal investigations, audit or security purposes;
  • to comply with Q-dees’ legal and regulatory obligations in the conduct of its business;
  • to contact you regarding product, services, upcoming events, promotions, advertising, marketing and commercial materials which we feel may interest you*;
  • to ensure that the content from our website is presented in the most effective manner for you and for your computer and/or device; and
  • for Q-dees’ internal records management.

(hereinafter collectively referred to as “the Purposes”)

* Where you have indicated your consent to receiving marketing or promotional updates from Q-dees, you may opt-out from receiving such marketing or promotional material at any time. You may select the “unsubscribe” option provided in Q-dees’ email blasts / SMS blasts or you may contact Q-dees at the details provided in Section (6) below.

(3) Disclosures and transfers of personal data (within or outside of Malaysia)

3.1 Entities within Q-dees

Your personal data provided to us may be processed by entities (within or outside of Malaysia) within Q-dees (including related companies, subsidiaries, holding companies, associated companies, outsourcing partners, nominees, our franchisee and/or third parties,such as credit card verification providers, data analytics, marketing agency, education-related businesses, safety and security personnel, parties which have business or contractual dealings with Q-dees and its subsidiaries or affiliates.)

3.2 Classes of third parties

Your personal data may be disclosed or transferred to relevant third parties (within or outside of Malaysia) as required under law, pursuant to relevant contractual relationship (for example, where we appoint third party service providers) or for the purposes stated in Section (2) above (or directly/ indirectlyrelated to those purposes).

In the event of a potential, proposed or actual sale of business, disposal, acquisition, merger or re-organisation (“Transaction”), your personal data may be required to be disclosed or transferred to a third party as a result of the Transaction. You hereby acknowledge that such disclosure and transfer may occur and permit Q-dees to release your personal data to the other party and its advisers / representatives. (i) Franchisees or potential franchisees: Your personal data may be disclosed to the following classes of third parties:

  • Any person to whom we are compelled or required to do so under law or in response to a competent or government agency;
  • Your sponsors including your parents / guardians;
  • Relevant professional or statutory regulatory bodies or accreditation bodies;
  • Law enforcement agencies; and
  • Third parties appointed by us to provide services to us or on our behalf (such as auditors, lawyers, company secretaries, printing companies, telecommunications companies, contractors, conference / training / event organisers, other advisers, travel agencies, recruitment agencies and insurance companies).

(iii) Parent/guardian of our student or potential student: Your personal data may be disclosed to the following classes of third parties:

  • Relevant government departments / agencies, statutory authorities and industry regulators;
  • Any person to whom we are compelled or required to do so under law or in response to a competent or government agency;
  • Relevant professional or statutory regulatory bodies or accreditation bodies;
  • Law enforcement agencies; and
  • Third parties appointed by us to provide services to us or on our behalf (such as auditors, lawyers, company secretaries, printing companies, telecommunications companies, contractors, conference / training / event organisers, other advisers travel agencies, recruitment agencies and insurance companies).

(iv) Vendor, supplier, tenant or service provider: Your personal data may be disclosed to the following classes of third parties:

  • Third parties appointed by us to provide services to us or on our behalf (such as auditors, lawyers, company secretaries, printing companies, contractors, conference / training / event organisers, other advisers, business partners, authorised or contracted third parties, service providers or advertisers);
  • Law enforcement agencies;
  • Government departments / agencies, statutory authorities and industry regulators; and
  • Any person to whom we are compelled or required to do so under law or in response to a competent or government agency.

(4) Websites

4.1 Links to other sites

Content in Q-dees’ website and the websites of our nominees (collectively, the “Websites”) may include links to third party websites. Q-dees is not responsible for the content on such linked third party websites and users should observe the separate privacy policies applicable to the respective third parties website.

4.2 Cookies

Q-dees may collect information about your visits to the Websites without you actively submitting such information. Unidentifiable information may be collected using various technologies, such as cookies, and web beacons. Cookies are small text files that are transferred to your computer’s hard disk by a website. Web beacons (also referred to as GIF files, pixels or Internet tags) help Q-dees recognise a unique cookie on your browser. Your internet browser automatically transmits to Q-dees some of this unidentifiable information, such as the URL of the web site you just visited and the browser version your computer is operating. We use cookies to recognise your preference information, keep track of your site administration. If you continue to browse our Website without changing your web browsers or device’s settings that control cookies, you agree to receive cookies when you use the services on our Website. Besides functionality and processing usage, these cookies also collect information about how you use our services such as which pages you visit regularly. These cookies are used to provide you high-quality experience by doing things such as tracking page load, site response times, and error messages and these cookies also gather information about your use of our services so we may improve your experience and provide you with more relevant content and advertising. They remember that you’ve visited our services and help us understand usage of our services. Some of these cookies are from third parties that collect information about users of our services in order to provide advertising (on our services and elsewhere) based on users’ online activities (so-called “interest-based advertising”) on our services and elsewhere online. The third parties involved in interest-based advertising collect internet browsing information (e.g. websites visited, time of visit) across different websites and over time, and they may use the information they collect on our services to provide you ads (from us and other companies) across the internet.

Passive information collection technologies can make your use of the Websites easier by allowing Q-dees to provide better service, customise the Websites based on consumer preferences, compile statistics, analyse trends, and otherwise administer and improve the Websites. Certain features of the Websites may not work without use of passive information collection technologies.

(5) Right to access and correct personal data

You have the right to access and correct your personal data held by us (subject always to certain exceptions). We will make every endeavour to ensure your personal data is accurate and up to date therefore we ask that if there are changes to your information you should notify us directly. If you would like to access or correct your personal information, you may make your request in writing to the contact details in Section (6) below.

(6) Limiting the processing of personal data, further enquiries and complaints If:

(i) you would like to obtain further information on how to limit the processing of your personal data; (ii) you have any further queries; or (iii) you would like to make a complaint in respect of your personal data,

(7) Conflict

In the event of any conflict between this English language Personal Data Protection Notice and its corresponding Bahasa Malaysia Personal Data Protection Notice, the terms in this English language Notice shall prevail.

By providing your personal data to Q-dees, you hereby declare that you have read, understood, accepted and give your consent to the collection and use of your Personal Information by Q-dees in the ways described above (which may change from time to time) unless and until you inform Q-dees to the contrary. If you have provided us Personal Information of third-party individuals in your application or submission to us, you are required to obtain the individual’s prior consent and you represent and warrant that you had or have their consent or are otherwise entitled to provide their personal information to us. By providing us Personal Information of third-party individual(s), you also warrant that the individual(s) is informed of and consents to the terms of this Personal Data Protection Notice.
